By accessing or using SalesWave, you agree to the practices described in this policy.

We collect information in three ways: information you provide directly, information collected automatically as you use the Service, and information from third-party integrations you connect.

2.4 Contact and Campaign Data You Import

As part of using SalesWave's CRM and campaign features, you may upload contact lists, lead data, and communication records. You are the data controller for this imported data; DataQuells processes it solely on your behalf and in accordance with your instructions.

Note: We process imported contact data as a data processor, not as an independent data controller. You remain responsible for ensuring you have lawful grounds to process and communicate with your contacts.

How We Use Your Data

We use the information we collect for the following purposes, all of which have a lawful basis under applicable law:

3.1 To Provide and Operate the Service

  • Create and manage your SalesWave account
  • Process transactions and send billing-related communications
  • Enable platform features including AI CRM, email automation, and WhatsApp campaigns
  • Maintain platform security, uptime, and performance

3.2 To Improve the Platform

  • Analyse usage patterns to identify bugs and improve features
  • Conduct internal research and product analytics
  • Develop new features based on aggregate user behaviour
  • Run A/B tests on UI and feature improvements

3.3 Marketing Communication

  • Send product updates, newsletters, and promotional offers — only with your consent
  • Personalise in-app notifications and onboarding guidance
  • Retarget ads on third-party platforms (where you have consented)

3.4 Customer Support

  • Respond to support requests, questions, and feedback
  • Diagnose and resolve technical issues using account and session data
  • Maintain records of communications for quality assurance

3.5 Legal and Compliance

  • Comply with applicable laws, regulations, and court orders
  • Enforce our Terms of Service and prevent fraud or abuse
  • Protect the rights, safety, and property of DataQuells and its users

Data Sharing

We do not sell, rent, or trade your personal data. We share data only in the limited circumstances described below, and only with parties bound by appropriate data protection obligations.

4.1 Service Providers (Sub-processors)

We engage trusted third-party vendors to help operate SalesWave. These vendors process data only on our instructions and may not use it for their own purposes.

4.2 Legal Requirements

We may disclose your data if required to do so by law, in response to a valid legal process (subpoena, court order, regulatory request), or to protect the rights, safety, or property of DataQuells, its users, or the public. We will notify you of such requests where permitted by law.

4.3 Business Transfers

In the event of a merger, acquisition, or sale of all or part of our assets, your data may be transferred to the acquiring entity. We will notify you via email and/or a prominent notice on our website at least 30 days before any such transfer, and you will have the right to request deletion of your data before it is transferred.

Data Security

We implement industry-standard technical and organisational security measures to protect your personal data against unauthorised access, alteration, disclosure, or destruction.

Data Breach Response: In the unlikely event of a data breach that affects your personal data, we will notify affected users within 72 hours of becoming aware of the breach, as required by applicable law, and will provide details of the nature of the breach and steps taken to mitigate it.

Depending on your jurisdiction, you may have the following rights regarding your personal data. DataQuells honours these rights for all users, regardless of location.

6.1 Right to Access

You have the right to request a copy of all personal data we hold about you. We will provide this in a structured, commonly used, machine-readable format within 30 days of your verified request.

6.2 Right to Rectification

If any of your personal data is inaccurate or incomplete, you have the right to request correction. You can update most of your account information directly from your SalesWave profile settings.

6.3 Right to Erasure ("Right to be Forgotten")

You may request the deletion of your personal data at any time. To request account deletion, email us at support@dataquells.com with the subject line "Data Deletion Request". We will process the request within 30 days. Note: some data may be retained for legal or contractual obligations (e.g., billing records).

6.4 Right to Opt-out of Marketing

  • Click "Unsubscribe" in any marketing email from us
  • Update your communication preferences in your account settings under Notifications

6.5 Right to Data Portability

You may export your CRM data, campaign history, and contact lists at any time from your SalesWave dashboard in CSV format. You can also request a full data export from our support team.

6.6 Right to Restrict Processing

In certain circumstances, you may request that we restrict processing of your data — for example, while you contest its accuracy or object to our use of it. We will honour such requests within the bounds of our legal obligations.

Cookies Policy

SalesWave uses cookies and similar tracking technologies (web beacons, pixel tags, local storage) to operate the platform, remember your preferences, and understand how users interact with our service.

7.1 Types of Cookies We Use

8.2 Third-Party Integrations

When you authorise a third-party integration (such as Google Contacts, Zapier, or a payment gateway), you grant that service access to certain data as described in the integration's own authorisation flow. DataQuells is not responsible for the data practices of third-party integration providers. You can revoke integrations at any time from your SalesWave account settings under Integrations.

Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or for other business reasons. We will notify you of any material changes as follows:

  • We will update the "Last Updated" date at the top of this page
  • For material changes, we will send an email notification to the address registered on your account at least 14 days before the changes take effect
  • We will display a prominent in-app banner for significant policy changes
  • Your continued use of SalesWave after the effective date constitutes acceptance of the updated policy
